Annulment

Subchapter B of Chapter 6 of the Texas Family Code covers situations where annulments may be granted.  The situations where a court would grant an annulment are typically in instances where:

  • the married couple is underage
  • One of the parties was under the influence at the time of the marriage and did not have the capacity to consent
  • One of the parties was permanently impotent at the time of marriage and the other party did not know
  • Elements of fraud, duress, or force are present
  • Mental incapacity issues
  • One of the parties concealed their prior divorce within 30 days of the new marriage
  • The marriage took place less than 72 hours after the marriage license was issued
